A Delhi District Court has dismissed a trademark infringement and passing-off suit filed by M/s Jagran Prakashan Limited against agricultural magazine Krishi Jagran.
The court not only vacated a multi-year interim injunction against Krishi Jagran but also slammed the plaintiff for initiating a "protracted litigation" with the malafide intention to eliminate market competition. District Judge Arul Varma ordered Jagran Prakashan Ltd. to pay Rs 10 lakhs in costs to the defendants for the "public ignominy" and undue hardship caused to them.
The legal battle began in September 2019 when Jagran Prakashan Ltd. moved the court, claiming exclusive proprietary rights over the wordmark and brand name "Jagran".
The plaintiff alleged that the defendants, M/s Krishi Jagran and its proprietor Mezhukanal Cherian Dominic, were unlawfully using "Jagran" across their print magazines, websites, and digital portals, thereby creating consumer confusion and riding on the global goodwill of the "Jagran Group" established since 1942.
However, Krishi Jagran contested the suit, stating that it is one of the world’s widely circulated agricultural monthly magazines and has been published continuously since September 1996.
