SC to hear Google, CCI, ADIF appeals against NCLAT ruling in Play Store antitrust case

The Supreme Court is set to take up appeals filed by Google, the Competition Commission of India (CCI), and the Alliance of Digital India Foundation (ADIF) challenging an order by the National Company Law Appellate Tribunal (NCLAT) in the ongoing Play Store antitrust case, reports Bar and Bench. The report further states that the matter is scheduled for hearing in November before Justices P.S. Narasimha and A.S. Chandurkar.
The case stems from a 2020 CCI probe into Google’s billing practices on the Play Store. In 2022, the CCI fined the search engine giant Rs 936.44 crore for abusing its dominant position by forcing app developers to use its billing system and limiting third-party payment options.
While NCLAT upheld the findings of abuse of dominance, it reduced the penalty to Rs 216.69 crore and asked Google to pay the revised amount within 30 days.
Both CCI and ADIF have challenged parts of the NCLAT ruling, including the dilution of some behavioral remedies that were initially directed to ensure fair competition in the app ecosystem.
Google argues that its practices do not amount to abuse of market dominance and that the restrictions were essential for user security and platform integrity.
