For the first time, Netflix has acknowledged that generative AI is being used in its projects; but, the streaming service is also establishing stringent guidelines for how producers must utilize the technology. The platform has released a set of rules designed to strike a balance between innovation and moral and legal obligations.
In a blog post, Netflix said: “Generative AI tools (GenAI) that allow users to rapidly generate new and creatively unique media (video, sound, text, and image) are increasingly being used across creative workflows in Content Production.” The company further added, “At Netflix, we see these tools as valuable creative aids when used transparently and responsibly.”
The recommendations highlight a number of requirements, including that created materials be transitory rather than final deliverables, AI systems not store or train on production data, and outputs not duplicate protected content. Crucially, without the talent's permission, generative AI cannot produce new performances or replace existing ones.
Additionally, Netflix has listed situations that call for prior clearance, including using AI for the primary characters, making references to well-known people, or using copyrighted prompts. The use of generative AI in content based on actual events has been expressly prohibited by the firm.
“Audiences should be able to trust what they see and hear on screen. GenAI (if used without care) can blur the line between fiction and reality or unintentionally mislead viewers,” Netflix stated, expanding on the reasoning.
By establishing these guidelines, Netflix is indicating that, even if it is amenable to AI in narrative, content integrity is still of utmost importance.
