Madison files fresh writ in Delhi HC, challenges validity of CCI provisions: Reports

Madison Communications has filed a second writ petition in the Delhi High Court, as per media reports, challenging the constitutional validity of key provisions of the Competition Act and several clauses under the recently notified CCI General Regulations, 2024.
In its latest filing, Madison has questioned the vires of Section 26(1) of the Competition Act, which allows CCI to direct an investigation by the Director General (DG) upon forming a prima facie view.
The agency has argued that the Competition Act does not grant CCI any disciplinary control over advocates and the provisions infringe the right to counsel and undermine procedural fairness.
The matter will now come up on January 8, 2026.
Earlier, the Delhi High Court had issued significant directions in Madison Communications’ writ petition against the Competition Commission of India (CCI), effectively restraining the regulator from taking any further steps against the agency or its senior leadership until the next hearing.
