Delhi High Court denies Google interim relief in Hindware trademark case

- In its appeal to the Delhi High Court, Google sought temporary protection from the ruling, arguing that the case did not involve consumer confusion or unfair trade practices.
- The two-judge bench acknowledged the appeal but declined to stay the damages or restrictions, scheduling a further hearing for July 24.
Google India has failed to secure temporary protection from a landmark court ruling that held the tech giant liable for trademark infringement over its advertising platform.
The case stems from a decision in May, which found Google liable for permitting advertisers to bid on the registered trademark of sanitaryware manufacturer Hindware as a Google Ads keyword. The initial judgment required Google to block the use of ‘HINDWARE’ and its variations as advertising keywords, alongside a ruling to pay Rs 30 lakh in damages and legal costs.
Appealing the decision at the Delhi High Court, Google’s legal team, led by senior advocate Abhishek Manu Singhvi, submitted that the case needed interim protection. Singhvi maintained that the situation did not involve consumer confusion, unfair trade practices, or consumer protection issues.
However, a two-judge bench consisting of Justices V. Kameswar Rao and Manmeet Pritam Singh Arora agreed to issue a notice on Google’s appeal, but they refused to stay the damages or the restrictions in the meantime.
