Bombay HC restrains Prashant Goenka from using Ramnath Goenka’s name in his newspaper

The court grants ad-interim relief to the Indian Express Group and orders defendants to not use image & name of the founder, Ramnath Goenka on websites, Facebook pages, media reports stated

According to media reports, Prashant Goenka runs a newspaper by the name of 'Sajaga Samachar Parivartan Ka' circulated in Bengaluru. According to a suit filed by the Indian Express, it says that Prashant Goenka has been passing himself off as the grandson of Ramnath Goenka and using the founder's image from the archives of the media group.

It was further claimed that Prashant Goenka has been using the image of Ramnath Goenka from the archives of the Indian Express group. This is a classic case of infringement and passing off, according to a news media report.

Hence, the plaintiff news publication had sought an injunction restraining Prashant Goenka from using the name for an upcoming award ceremony to be held on November 24.

The court restraints Prashant Goenka and others from trading the name and image of the Indian Express group founder Ramnath Goenka on his newspaper, 'Sajaga Samachar Parivartan Ka',  circulated in Bengaluru to collect funds.

Seeking a perpetual injunction, a single bench of Justice SC Gupte has been hearing the infringement suit filed by Indian Express. The court observed that any such action of passing off is an attempt by the defendant to mislead the public of any goods of the plaintiff as his own, media reports stated.
