The Delhi High Court has sided with quick-service restaurant chain WOW Momo Foods in a trademark dispute, ruling that another company cannot use the name “WOW Burger” as it infringes on WOW Momo’s registered brand identity.
A Division Bench of the Court overturned an earlier September 2025 order that had refused interim protection to WOW Momo. The judges found that the rival mark “WOW Burger” was confusingly similar to WOW Momo’s established trademarks such as WOW MOMO, WOW DIMSUMS, and WOW MOMO INSTANT, and could mislead consumers into assuming a connection between the two brands.
The bench recognised that WOW Momo had developed a distinctive naming pattern built around combining the exclamation “WOW” with various food items, creating a recognisable family of marks. The court noted that this “WOW + food” format has become an identifying feature of the company’s brand identity and deserves protection against imitation.
However, the court clarified that WOW Momo’s rights do not extend to the word “WOW” by itself, but rather to the unique composite marks it has built using that structure.
