The Delhi High Court has officially resolved the decades-long trademark battle between confectionery leaders Mars and Cadbury over the “Celebrations” brand. The court sanctioned a mutual settlement, bringing closure to a dispute that began in 2018 when Mars challenged Cadbury’s use of the name for its assorted chocolates, according to media reports.
The companies have reportedly decided to drop all ongoing opposition and correction cases filed with the Trade Marks Registry. Under the terms of the settlement, neither Mars nor Cadbury will pursue any future claims or demands against the other, effectively bringing the dispute to a complete close.
“Today, that long journey finds its conclusion. The curtains are drawn at last, not in discord, but in harmony,” the court reportedly said.
Before parting, it bears recording that the real measure of this case lies not in the volume of pleadings or argument, but in the conduct of the parties at its close. By choosing an amicable resolution, these two reputed companies, once adversaries, have together restored the plain sense of the trademark they long contested. ‘CELEBRATIONS’ now denotes joy that is shared and not divided,” the judge in the case was quoted by media reports as saying.
