Court restrains Apollo Tyres from running 'defamatory' ad against CEAT

In a plea, CEAT has complained that a video uploaded by Apollo shows CEAT’s CROSSDRIVE AT tire in a bad light

The Bombay High Court has passed an injunction against Apollo Tyres preventing it from airing “defamatory" ad against CEAT.  The order was passed on September 12.
 
The petition in the case was filed by CEAT. In the plea, CEAT shared that the company has discovered
a commercial uploaded by Apollo on its YouTube channel, promoting its Apollo Apterra AT2 tire for use in the Mahindra THAR, a sports utility vehicle. The video shows CEAT’s CROSSDRIVE AT tire in a bad light.
 
The court found that the commercial was "prima facie" derogatory and disparaged CEAT's product. 
 
"Under these circumstances, I am convinced that the Plaintiff has established a strong prima facie case for the grant of interim relief," the judge reportedly stated. 
 
“The balance of convenience is in favour of the plaintiff (CEAT Ltd),” the court said. “Unless reliefs as prayed for are granted, the Plaintiff will suffer irreparable harm/injury which cannot be compensated in terms of money.”
 
The court will hear the case further on October 11.
