SC stays defamation proceedings against Rajdeep Sardesai

Veteran journalist Rajdeep Sardesai has been involved in a case of making false allegations against a senior Hyderabad police officer with respect to the 2007 Sohrabuddin encounter case.
In a latest development Supreme Court stayed criminal defamation case proceedings against Sardesai in the case.
Apart from Sardesai there were seven other journalists named in the case. They are Sidhartha Gautam, Swati Vashishta, VK Shashikumar, Ahmed Ali Shaik, Gulab Kotari, Hemender Sharma and Lateef Mohammed Khan.
Media reports suggested that during the brief, the hearing bench suggest that Sardesai and other have decided to file a new petition after their plea was dismissed.
The report also highlighted that journalists filed a fresh petition on the issue after the apex court on 15th of May junked their appeals against summons issued to them for allegedly defaming the senior inspector.
The court had upheld the judgement passed by the Andhra Pradesh High Court rejecting the petitions for quashing initiation of criminal proceedings against the journalists under Section 482 of the Cr PC saying it was perfectly legal and valid.
While dismissing the appeals the court also said, “The same does not call for interference by this court in exercise of its appellate jurisdiction as there is no substantial question of law framed in the appeals nor is there any miscarriage of justice for the appellants to interfere with at this stage.”
