The Delhi High Court has cited the large volume of cases lined up for hearing & TRAI not yet filing its rejoinder in the case as the prime reasons for postponing the date of final hearing

Ad cap case: Date for final hearing pushed back to September 25

The Delhi High Court has fixed September 25, 2014 as the date for final hearing in the 10+2 ad cap case. The decision was taken at the hearing in the Court today, July 15.

The two reasons were cited for postponement of the hearing date – a) the Delhi High Court has a large volume of cases to attend to, which will leave it with not enough time to hear the ad cap case on July 15; and b) the Telecom Regulatory Authority of India (TRAI) is yet to file its rejoinder in the case.

As is known, some of the parties associated with the case include the News Broadcasters Association (NBA), B4U, 9X Media, TV Vision, Sun TV Network, E24, and Kalaignar TV against the Telecom Regulatory Authority of India.

At a previous hearing on May 6, 2014, Saket Singh, the counsel for TRAI, the respondent in this case, pointed out, “In some cases, a few broadcasters have been found violating the ad cap rules, with the violations sometimes extending to almost 20 hours a day.” The counsel had pleaded for an early hearing in the case.

At its December 2013 hearing, the Delhi High Court had given temporary relief of around three months to broadcasters when it asked TRAI not to take any coercive action against the news broadcasters for not following the 12-minute mandated ad cap. The broadcasters were asked to send their weekly advertisement data to TRAI. The order was passed following a writ petition filed by the broadcasters on December 17, 2013 to get the ad cap reviewed quickly.
