As interim relief, HC instructs Sony to carry Parle ads on IPL HD feed

Sony, the official broadcaster of IPL, has been sued in the Bombay High Court by Parle Products.

The sticking point between the broadcaster and the advertiser is the denying of screen presence to Parle on Sony’s HD feed. Sony says that HD feed was a separate package while Parle says that there was no formal communication regarding the same and there was no knowledge of the HD feed coming under a separate package and not as a bundle.

Parle is an associate sponsor of IPL, the cricket extravaganza which is being aired on Set Max, Sony Six and Sony Six HD since April 3, 2013.

Commenting on this, Pravin Kulkarnii, GM-Marketing, Parle Products said, “Advertisers are paying for the complete property of IPL and not for any one channel of Sony. If we do not get both the feeds, then we are at a loss! Sony should have clarified this at the beginning. We have taken a legal action against Sony and filed a petition in Bombay High Court and the matter is Sub Judice. The court has given us interim relief and now Sony is airing our ads on Sony Six HD too. If Bombay High Court gives a favorable verdict, then we will not be liable to pay Sony for the HD channel separately. However, if the verdict goes against us, then we will be liable to pay the channel for the ad inventory taken by us on Sony Six HD.”

Responding to the story, Rohit Gupta, President, MSM said, “The court has passed an interim order on Friday that Parle would need to pay for the HD feed. Parle, therefore, will have to pay as required. As far as ambiguity regarding packages is concerned, there was no ambiguity since the beginning and everything was clear.”

The Parle ads are currently being aired on Sony Six HD but both the sides are firm on their individual stands. It has been learnt from sources that some more advertisers are likely to follow the suit of Parle, but no advertiser has officially confirmed anything on records.
