HC restrains Information TV from using the name ‘Ab Tak’ for forthcoming Hindi news channel

The Delhi High court has granted ad interim ex parte injunction against Information TV Pvt Ltd from using the name ‘Ab Tak’ for its forthcoming Hindi news channel. The Court has also restrained the use of any other name which is deceptively similar to TV Today Network’s (TVTN) Aaj Tak. This was revealed in a statement issued by TVTN.

Information TV is a media house promoted by Kartik Sharma, son of former Union Minister Venod Sharma. The media company plans to start an English news channel ‘ITV’, along with a 24-hour Hindi news channel soon.

TV Today Network, which has channels like Aaj Tak, Dilli Aaj Tak, Tez and Headlines Today, reacted to the mention of the name Ab Tak in newspapers and websites in ads for job vacancies. The Network approached the Court seeking an injunction against use of the name ‘Ab Tak’.

Justice B D Ahmed granted an ad interim ex parte injunction restraining the use of the name ‘Ab Tak’, which is deceptively similar to TVTN’s Aaj Tak. The High Court recorded that prima facie confusion and deception would occur through the use of the name Ab Tak by Information TV.

Summons and notices have been issued to the Defendant, Information TV Pvt Ltd, returnable on February 5, 2008. In view of the aforesaid order, Information TV had been restrained from using the name Ab Tak or any deceptive variant in respect of its proposed Hindi news channel, the TVTN statement added.
