The Delhi High Court has adjourned the 10+2 ad cap case till January 21. This gives broadcasters a window of relief.
In the last hearing on September 25th , the HC had fixed November 20, 2014 as the date for final hearing in the 10+2 ad cap case.
It was learnt that today the case was adjourned because HC didn’t have time to hear the case. The court said there are a few more cases pending and it will proceed to finish them first. The next hearing will be on January 21st, 2015.
As is known, some of the parties associated with the case include the News Broadcasters Association (NBA), B4U, 9X Media, TV Vision, Sun TV Network, E24, and Kalaignar TV against the Telecom Regulatory Authority of India.
At the previous hearing on May 6, 2014, Saket Singh, the counsel for TRAI, the respondent in this case, pointed out, “In some cases, a few broadcasters have been found violating the ad cap rules, with the violations sometimes extending to almost 20 hours a day.” The counsel had pleaded for an early hearing in the case.
At its December 2013 hearing, the Delhi High Court had given temporary relief of around three months to broadcasters when it asked TRAI not to take any coercive action against the news broadcasters for not following the 12-minute mandated ad cap. The broadcasters were asked to send their weekly advertisement data to TRAI. The order was passed following a writ petition filed by the broadcasters on December 17, 2013 to get the ad cap reviewed quickly.
