TDSAT tells DEN to pay Zee Rs 10 cr; orders audit of its systems

TDSAT ordered Den Networks Ltd  (DEN) to continue telecasting ZEE channels as per the agreement which expired on December 31, 2017. It also ordered DEN to pay Rs. 5 crore immediately and another Rs. 5 crore within a week.

“As an interim measure, in the facts and circumstances of the case, we direct that the present arrangement between the parties as applicable till 15.1.2018 shall continue till the next date. However, for this we require the petitioner to make on account payment of Rs. 5 Crores by tomorrow and another amount of Rs. 5 Crores within a week,” the Tribunal said in its order on January 15, 2018.

However, the Tribunal also considered the petitioner’s, in this case DEN's, submission that Broadcast Engineering Consultants India Ltd (BECIL) be directed to hold an audit of “the petitioner’s system urgently and the petitioner would offer all facilities, cooperation and supply all the required historical data to find out whether the petitioner’s system is regulation complaint or not.”

“BECIL shall conduct the audit after intimation and/or in presence of respondent’s representatives. The audit in the facts of the case is required urgently so it should begin on the request of the petitioner to BECIL, within three days from today. A communication shall be made by the petitioner within 24 hrs,” the tribunal directed in its order and request BECIL to supply it the audit report by the next date and to the parties within 10 days.

The court also added that it expected both, DEN and ZEE, to agree on the outstanding dues by the next date.

“By the next date we expect both the parties to either sit across the table and agree on outstanding dues or else each one of them shall furnish, on oath, their respective accounts showing total outstanding in the light of all materials available with them including their books of accounts. They shall have also liberty to file additional documents, if required," the Tribunal said.
