The interim order against Emami Ltd barring them to use the name of Activor Corporation of USA in the packet of its fairness cream for men, had caused a loss of Rs 20 lakh per day since January 25, 2006.
This statement was made today by the counsel for Emami during the hearing of the case before Justice K J Sengupta of the Calcutta High Court.
Justice Sengupta had made the order, responding to a suit filed by a city-based group of businessmen as petitioners alleging that Emami using the name of the foreign company in its product without obtaining the permission from the USA company.
Emami opposed the interim order and received support from the Activor, USA.
Since Tuesday Emami tries to vacate the interim order but as the hearing is continue, the order was not yet vacated.
Emami counsel concluded his argument but the counsel for the petitioners continued his argument so the matter will listed on February 6, 2006, for further hearing.
Both the counsel for Emami and Activor USA argued that the case was baseless and should be dismissed with cost.
USA company's counsel admitted that it had given permission to Emami to use its name and raw materials in the Emami's product.
Emami counsel alleged that there was no proper agreement between the Activor and the petitioners.
