BharatMatrimony.com wins legal battle against trademark infringement by a malicious portal

Matrimony portal BharatMatrimony.com has succeeded in its legal battle against a malicious website for infringing its domain name and trademark.

According to an official communiqué, the company had recently discovered domain name infringement by website called www.bharathmatrimony.net, another matrimonial website which was promoting itself as ‘India’s No. 1 Matrimony’. Following this, the company instructed its legal consultant Rama Sarma, Partner, Kochhar and Co, to initiate appropriate legal proceedings to restrain the domain name and trademark infringement committed by Bharathmatrimony.net and sought an injunction at the Madas High Court restraining bharathmatrimony.net from infringing its trademark and operating a malicious website having an identical domain name.

Justice V Ramasubramaniam, who heard the case, passed an order of injunction restraining infringement and passing off, upon hearing the arguments put forth by J Sivanandaraaj, counsel for the company. BharatMatrimony.com is operated by Consim Info Pvt Ltd and promoted by Murugavel Janakiraman. The portal also holds the Limca Book of Records for a record number of documented marriages online.

The company operates matrimony portals, registered in the domain names: Bharatmatrimony.com, Assamesematrimony.com, Bengalimatrimony.com, Gujaratimatrimony.com, Hindimatrimony.com, Kannadamatrimony.com, Keralamatrimony.com, Marathimatrimony.com, Marwadimatrimony.com, Oriyamatrimony.com, Parsimatrimony.com, Punjabimatrimony.com, Sindhimatrimony.com, Tamilmatrimony.com, Telugumatrimony.com, and Urdumatrimony.com.

With this success, the company intends to initiate legal action against other similar malicious websites having identical / deceptively similar websites.
